It is legal for them to post your mugshot as that is public property, however, it would be illegal for them to charge a fee to remove information that would be considered false.
Meaning if you were found not guilty, and you ordered it to be removed, and they wanted to charge you, this would be defamation. If you were convicted the states are true and you could therefore be responsible to pay to have it removed.
