Hmmm. I will agree the Special Purpose Automatic Shotgun version built from 1979-1989 would be illegal as it has additionally a folding stock and high capacity magazine tube.

Why? The Later model named as Sporting Purpose has a restricted Magazine Tube limiting the shotgun to Five or Six shells not Eight in the tube, it also has a fixed synthetic stock that is not a folding stock version. These restrictions were made by the federal government to stop the importation of the Special Purpose in 1989. Later in 1990 the importation was continued as it was considered a sporting shotgun by the ATF ruling and not a military shotgun with the cosmetic changes and restrictions.
If I was a Judge and had to decide it would be a gray area if it is the Sporting Purpose SPAS-12. Check the two digit date code ahead of the loading port to confirm proofing and the manufactured date. Sporting Purpose Automatic SPAS-12 Shotguns were only manufactured by American Arms with the following Date Codes. AZ=1990 BA=1991 BB=1992 BC=1993 BD=1994. If the date code is after 1994 its a federal crime of illegal importation into the United States.
