President George Bush actually went to Congress and got Congress's approval for the use of Military Force, which is a type of war declaration. There were actually at least three such war authorizations that would apply to Iraq. Any one of them would have been well within the requirement of the Constitution. The "Authorization for Use of Military Force against Iraq" was approved by Congress in October 2002. Congress had previously given the Commander-in-Chief a very general authority for the War on Terror, which would include war in or against Iraq, which was a known and proven supporter and haven for terrorists. That authorization was granted just after 9/11. And George W. Bush could have invaded Iraq under authority of the Iraq War resolution of 1991 that his father G. H. W. Bush had been granted by Congress. Why? Because Saddam had never surrendered in that war, since the end of the active campaigns to take back Kuwait there had been a series of ceasefires, breakings of the ceasefire, and continuing missile and air raids by the US to enforce the ceasefire agreements -- the war was in low-grade sort-of-pause but it was still a war. That's not a "loophole"!

He hasn't. Congress approved his descision to go to war against Iran/Iraq. In congress, at least 66 percent of the vote has to be a positive for war to be declared-or any other descision to be made as well. In congress, they will send things called bills to the president, and the president decides if the bill is worth making into a law. If it isn't, it's sent back to congress, and congress can either improve the bill and send it back or override the president. If congress can ovveride the president on something as small as a law, that just proves how little power the president has in general. Democrats as well as Republicans on the congress approved the war at the time, even if the majority of them are against the war today.
Because the Constitution vests that power in the Congress. Since WWII though, successive presidents have sought to increase presidential power and thereby diminish the power of Congress. There was never a declaration of war for Korea or for Vietnam. There may have been one for the Gulf War in 1991, but only after the president had spent six months moving the American military to the border of Iraq, and as an afterthought sought the approval of Congress. There was no declaration of war for Afghanistan or Iraq this time around. Just some half-baked resolution, or something or other, given based upon the heap of distortions, misrepresentations and outright lies told to Congress by the Bush administration to justify what they wanted to do.
