Law, Congress made law that allows federal agencies to make or change law that affect their agency. An example the dept of education in collecting student loans change the law for totally disabled. The law was (and still is for the military) when a total and permanently disabled person requested their student loan be waived the if granted all the money collected from the disabled person after they became disabled was returned. The department of education changed the law as to when the disabled person became disabled. To the date the TPD form is completed by a doctor. When the reality of the change was involving military personnel the VA said no way, ED will return all the money collected from a disabled Vet from the date they became disabled, the law was changed back only for the military. People who had their Social Security Disability Insurance garnished by higher Education to repay their student loan, to add the interest and fees were more then the Garnished money on just a $2,500.00 loan. had lost all the money they had payed in after they became disabled and unable to work. True most disabled persons filed the TPD form with higher Ed soon after becoming disabled, however those with mental illness and post traumatic stress disorder, who could not go to a doctor to have the TPD form completed were ripped off and economical hurt by the law change Higher education made. Again the change was the date Higher Education determined the person became disabled, being the date the TPD form was signed by a doctor. Ed claimed doctors were filling out the TPD form putting fraudulant dates as to when the person became disabled. My opinion a doctor is not going to risk his licence by putting false information on a TPD form. For ED to believe a docor that they taught for 8 to 12 years would risk a felony to help a person by lying on a form makes me believe The Department Education has administrators that are puppets of Sallie Mae.
