You are within your legal rights to simply request a person who has no right to occupancy or ownership to leave the residence. You must give the person a reasonable amount of time to gather their belongings (24 hours is usually sufficient). You may not refuse to allow the person to take items which they rightfully own, in lieu of rent, property damage or other issues. If they do leave willingly, the homeowner can enlist the assistance of law enforcement that holds jurisdiction.
