If they felt there was any way for you not to be at fault and for them to not have to pay out the claim to the other party they would have taken it. Just because you don't think you are at fault does not mean that the court would side with you. If you read you policy you will see that it at the option of the insurance company to settly claims. The don't have to spend legal fees just to make you happy. Sorry.
