Was this house purchased during the time you were married? If that is the case, it is joint property regardless of whose name is on the loan and deed. You are responsible for the debt in the amount assigned to you when your marital assets and liabilities were distributed. If it has been decided that you have no interest in the property, then you are not responsible for the debt. Your agreement to stay in the house until it is sold is something that will be hard to enforce should you decide to leave. Check with your attorney, but I don't think you are obligated in any way to a house that is not yours and is not going to be your responsibility. Tell your ex you can no longer stay there and let him worry about his property.

The divorce decree has NOTHING to do with the contract between the lender and whomever signed it. IF your name is on the contract, you will be responsible for the balance due until it is paid in full or discharged by B/K. The first thing to TRY is get possession of the car and sell it.
Unless it is agreed upon beforehand, all property acquired during a marriage in California is considered community property. This means that it is split evenly upon a divorce.
My ex-husband recently retired from the U.S. Army. In our divorce papers, he agreed to give me 35% of his retirement pay per month. How do I go about getting it?
No. A divorce decree has no legal status when it pertains to the lender's agreement. The party that wishes to keep the vehicle will need to refinance it in their name only.
If your husband has joint legal custody he can contest you moving the child form the state where you share custody
Do-it-yourself divorce forms are a great option if the divorce is "uncontested" (agreed on by both parties).
Generally, no other relatives except for a spouse is responsible unless they agreed to be responsible in writing. In the U.S.A it will finish faster.
The fact that you both agree to the divorce will make this divorce a lot easier and possibly a bit faster. You can file an uncontested divorce.
There is no universal answer to your question. Distribution of assets in a divorce can be agreed upon by the parties. If the parties cannot agree the court will make a division based on such factors as the length of the marriage, whether there are children, the economic position of the parties and their ability to acquire assets in the future.
Marriage & divorce laws need reformation. It should be universal for all. If ex-wife's husband agreed to pay or court has given decissions to pay, there is no problem to utilise the income in favour of child support.
