I'd say that was a dodgey (broken) battery or firmware, send it back to wherever you got it.

If the unit cools when it is hot-wired, look for a bad a/c relay.
You most likely have a dead battery, or if the battery is fully charged maybe the electrical portion of the ignition switch could be faulty.
It's been an awfully long time since I've seen this, but I incline to a bad voltage regulator.
The battery may not be fully charged to turn the engine over fast enough to start. The fuel pump may not be pumping fuel to the engine.

Probably the battery pack is wearing out. Try a new one.
Our original battery had to be replaced about 4 months ago (we have a 2005 500). The battery showed it was fully charged --- but it wasn't. This was the original battery that came in the car. You might take the battery out and take it and have it professionally checked at a parts store. We thought something else was wrong with the car since it wouldn't turn over, but it turned out to just be the battery.

You need professional legal advice. But if I were charged with the "wrong" crime, I don't believe I'd be saying "I did X, not Y." I'd just be saying "I didn't do Y."
