The trust instrument should contain the provisions indicating the standard the trustees must follow for distributions. Typically, though, distributions are at the discretion of the trustee.

As a beneficiary of a discretionary trust, the solicitors acting as trustees will have the power to make decisions on whether, when, and how to distribute the trust funds to the beneficiaries. Their decisions will be based on the terms outlined in the trust deed, which will detail the criteria for distributions and the beneficiaries' interests. It is advisable to review the trust deed and consult with the trustees or legal counsel to understand how the trust will operate.

This why their is a problem with the grantor leaving a institution or attorney's as trustee they have their own interest at heart no matter the current law. The laws should change to where all beneficary's should know about the trust and what a trust instrument states. To many money hungry attorney's, judges and institutions.

the surviving spouse is the legal beneficary unless otherwise stated Her Children. Each state has rule of intestacy that specify how an estate will be divided if there is no will. Typically the spouse will inherit all, but if there are children it is often divided into halfs and the spouse gets half and the children get the other half.

Can a life insurance company say you are not eligible to cash policy on Ex husband who died recently that you have been paying for 19 years?

When an insured person dies, presuming the policy is "in force," and the contestable period is past (two years from the date of issue), the insurance company pays the death benefit to the beneficary(ies). Cashing in a policy usually can only be done by the owner of the policy, or by someone to whom the policy has been assigned, prior to the death of the insured.
