Hmmmm, I don't see a cell phone in that list as a fundamental right. Cell phones are a privilege, not a right. Didn't your parents take away your goodies when you were punished? Unless your child is in a place where there is no supervision, you should do as you see fit, which might include taking the phone privileges away.
Alright...this is cowgirl4ever and I actually think that in some cases it is necessary but don't go crazy with the power of being able to "take your phone away". Like say your child has a C in algebra. If its not the report card, chill out. Their grades WILL get better with just a simple lecture. No, parents should not be upset when their childs has their cell phone taken by an educator at school as long as the cell phone is given back to the child at the end of the day (cells phones for children should only be for calling parents to let them know where they are or for parents to call their children as it is a form of safety.) Schools are a place of learning and it should be mandatory that student's cell phones are shut off while in class. They have lunch breaks to make any phone calls they need to make. An educator will only take a cell phone away from a student if that student is not paying attention to studying or listening to the educator and is talking on their cell phone.
