The Texas Apartment Association lease does not stipulate smoking vs. not smoking in the apartments. That would be included in the individual property's community policies. However, if you choose to smoke in your apartment be prepared to be pay extra to repaint, extra in cleaning the carpet and probably a fee for an ozone machine and/or hvac vent cleaning. Nearly all have patios or balconies- just smoke out there.
