The US acquired free navigation of the Mississippi River in 1795. This was established through a treaty which Pinckney negotiated.

Pinckney's Treaty guaranteed Americans free shipping rights on the Mississippi river and defined the boundaries of the United States with the Spanish colonies.
This latitude followed the Southern border of the new state of Missouri. It was taken as the parallel that would mark the divide between slave-states and free soil, in the rest of the lands acquired from France in the Louisiana Purchase. It kept the peace for thirty years, until the huge territories acquired from Mexico rendered it obsolete.

In February of 1861, the Provisional Confederate Congress passed a bill that Jefferson Davis signed into law declaring that the navigation of the Mississippi River was to open for the Union and the Confederacy. One purpose of this law was to relieve any fears of Union states that needed the river to transport and to receive products. It also was meant to drive a wedge between the Union states on the issue as to whether the Southern quest for independence was to be opposed or left alone.
