I'll go over both for you. Affirmative Possible Values include: Protection of Freedom and Liberties, Protection of Human Rights, Justice, Rule of Law (Or something similar, of course). i dont think that we should. if we do, then we give up the right to defend ourselves from an attack and that is not what the US does. I would say that the US should submit to the jurisdiction of an international court because then it shows that the US is willing to work multilaterally, increasing US soft power. Then the US would have a higher approval rating in the world. I also don't think that by submitting to an international court means that we give up the right to defend ourselves. It just means that we won't be able to commit crimes against humanity (which we shouldn't be doing anyway) without being called into question by the court.

Darfur is an example of the application of international criminal law. The case is an example of the application of international law. Although Darfur is not party to the Rome Statute creating the ICC, it was granted jurisdiction by the UN. The ICC thus offers an enforcement mechanism to punish especially severe crimes deemed to be directed 'against humanity'. The fact that most of those indicted have not been apprehended also shows the limits set to the enforceability of international law, which is very much dependent on sufficient international political backing.
