International law, and not U.N. "policy" dictates what can be claimed.
Generally, 12 miles from the low-water mark of a coastline can be claimed as "Territorial Waters". Where the distance to another country's coast is less than 12 miles, the line usually is drawn in the middle of the waterway.
There is also an exclusive economic zone (used to regulate oil/fishing rights, etc.) that is 200 miles from the coastline.
