A possession offense is usually being charged of possessing something illegal in the country you are being charged such as drugs, or paraphernalia (property/images etc...) depending on what the possession is and the amount of what ever it is you are charged with possessing it can be a minor or a federal offense. Yes. Suppose a police officer sees you with a gun and sees you throw it. He catches you, but you do not have it on you. You can be charged with possession of the gun. Suppose you are in your apartment and drugs are in the apartment bit not on you. The police can charge you with the drugs. This is not a game of tag where you have to be touching something for it to count.
