Adams used the President's power to nominate political officials with the advice and consent of the Senate, as outlined in the Article II, Section 2, Nomination Clause of the Constitution. While justices of the peace, like Marbury, were not specifically mentioned in the Constitution, Congress authorized the President to make these appointments in the Organic Act of 1801.
