The following is an eviction notice for an RV given to me, word for word, by a local precinct judge. It works!
NOTICE TO VACATE
(date) (to [name of renter] + [all other occupants] of (space #), (Park Name), (Address) (County), TX
"In accordance with the statutes of the State of Texas, you are hereby notified and required to quit and deliver up peaceful possession of the premises you now hold, per Park Rules and Regulations, and/or non-payment of rent due."
"Said premises are situated and described as follows:
(Space #)
(Park Name)
(Address)
(County)
(City), TX
"Should you fail to comply with this request to vacate the said premises by (day, date, year), then I shall proceed against you as the law directs." I insert date and time 72 hours from when the notice is posted. However, that is a courtesy and you should, and can, if you believe there is any threat to personnel or premises, require they leave sooner.
(Signed and dated by Park Owner/Manager)"
--At the 72 hour deadline, if they have not corrected the problem, whatever it is, you may disconnect and remove their property from the RV Park (assuming it is Private Property)
Because you are not taking the 'roof from over their head', the 30 day eviction process requiring a court proceeding DOES NOT APPLY.
I do have a standard rental agreement signed by all long term tenants, but that is not required if you have Park Rules posted anywhere; the laundry, picnic area, pool area, etc. And even then your verbal statement of rules violated should be sufficient.
This process has never failed to get the job done, and I have never had to resort to having a sheriff's officer called to witness or assist.
If they're your tenant, then you have a rental agreement. It may not be in writing, but if you gave them keys, and they gave money, that's a rental agreement. Each state has different laws about evicting, but some process is required.
