From my research on the Web and related articles, unemployment fraud is beginning to be prosecuted more aggressively due to the increase in fraudulent activities. However, most of the prosecuted cases were based on intent. If it proved that you intentionally received benefits fraudulently, you will be prosecuted and the normal is 5 years which is usually reduced to probation. However it is a Felony offense if you receive more than $250.00. The "intent" mostly results in people finding employment and yet continuing to file the claims. Or, they use a stolen or fake identity to establish the claim. The sad part is, here in the state of ALA, you can't get anyone on the phone to answer questions to see if you are even committing fraud unintentionally.
