The Vice President and the Senate would need to vote to decide if the president is disabled enough that he can not serve anymore. The president can also resign if he feels he can not serve anymore.

It is ultimately up to Congress whether or not the President of the United States is fit to serve if he/she becomes disabled during term of office. Medical personnel are also in on this decision.

This is spelled out in the 22nd amendment of the constitution. The president himself can decide he is disabled and that is the simple case. If his cabinet thinks he is disabled but he thinks not, there is a procedure that can be followed.

The vice-president plus a majority of the Cabinet can decide that the president is unable to serve unless the president disagrees. If the president disputes his inability to serve, Congress resolves the dispute and a 2/3 majority is needed in order to rule against the President.

A disabled US president can temporally or permanently have his powers given to the Vice- President. The 25th amendment gives procedures whereby the President can voluntarily give up his power and how he can be stripped of his powers involuntarily. It also gives a process whereby the President can regain his powers.

Amendment 20 of the constitution deals with this possibility. If the presidents states in writing that he can not perform his duties, the vice-president performs them. If the president can not or will not state that he is disabled, but in the opinion of the vice-president and a majority of his cabinet, he is unable to perform his duties, the vice-president can be authorized to perform them. The amendment also provides for restoring the president's powers if he recovers from his disability.
