As with all legal issues, that depends upon jurisdiction. For example, here in Canada (where I am typing) there is no death penalty, no matter what you do - although the police can still shoot you in self defense, if you are shooting at them. That is something like a death penalty although it is not exactly the same. In the US you can be sentenced to death for such things as multiple murder and high treason.
It all depends what country or what state you are in which will determine what it is you have to do to get the death sentence.

Death penalty is used where one think there is little hope for the person to ever become better and be a positive resource to the society ever again.
One must on the other hand be 100% sure that it is the correct person who get sentenced to death. If there is a possible doubt regarding who did what, then death penalty is not an option.

A most disgusting person who sweet-talks other people to do his/her dirty work in a most disgusting manner might receive the final judgment as well. Especially if an entire society is touched by the repeated evilness of that person.
