When a foreclosed house is sold at auction for more than the amount due that money if unclaimed is held by the county or state until claimed How do you find a list of those unclaimed funds?

Each state is required to keep those funds and a list of who they are owed to at one of their offices, most are: Comptroller of Public Accounts, Secretary of State, or the Treasurers office (etc.). A search for unclaimed property and your state name (since it is not in the question) should produce the results you are looking for. NOTE: there are services that charge money for these claims, do not use them, the states provide all this to you without a fee and these services are normally a rip-off.

Do you notify creditors of your bankruptcy or does your attorney?

You have to provide the court with a list of all your creditors, called the creditor matrix, which the court uses to send notice to all creditors.

Do you have to list all credit cards when filing for bankruptcy even one with a 0 balance?

Can a creditor take you to arbitration after your bankruptcy has been discharged?

No, the court discharge of the debt means it no longer exists! The filing of the bankruptcy prohibited every creditor from taking any action to collect (other than those required to the bankruptcy court). Of course, you had to handle your BK properly, and list all your creditors and all your assets, etc....if not you have lied to the court and they don't look at that too well.

How can I obtain copies of my 2003 Ch 7 bankruptcy papers. I'm mainly looking to get copies of the list of creditors. Any help is greatly appreciated?

If the bankruptcy court where you filed your case has sent your file to the archives, then you will have to request them from the archives. Call the bankruptcy court, they will send you a form to order your bankruptcy case file from the archives. Takes less than 3 weeks and costs under $20.

If an account was not listed on the creditor's list of a chapter 7 is it still dischargable under the bankruptcy?

Yes it is. The presumption of bankruptcy is that all of the bills that were owed will be discharged at the time. If for a reason the bill that wasnt listed came up it can still be discharged by the court. Your attorney can file an addendum for this with the court after wards.

Cause usually when you file for bankruptcy after you have filled out all the paperwork and paid the court fees to file for the Bankruptcy and it is now your court date. The judge will say your name, list all the creditiors youowed and how much. then he grants the bankruptcy- ** therefore they would not be able to garnish your wages. UNLESS IT IS FOR IS A GOVERMENT BILL- LIKE DEPARTMENT OF MOTOR VECHILCES, PARKING TICKETS, IRS, COURT - ie: LAWSUIT, DIVORCE, CHILD SUPPORT etc. HOPE THAT HELPS.
