Thats a Federal building and Court you've been working with.

Bankruptcy is a Federal law.

Let's see...you make promises to all types of people to get them to lend you money (so you can think more of yourself I guess), and how you'll pay them back, and swear and sign how you'll do so. But then you don't.

You go crying to the law..."Oh please protect me...I promised people I'd do things, but I don't want to keep my word, and they are so mean...they want me to give up stuff I have just because I swore and promised I would...please...courts, law, assign a trustee to protect me and my stuff from everybody...I can't do it myself, or be expected to honorably act like I promised...."

They step in and do it. And you swear and promise, and even sign a zillion places, that for them doing so, and continuing to do so, you'll do the things they need you to to resolve the mess YOU made. Others will get hurt for forever, but you'll come out fine.

And now, you don't do that either. Anyone going to be suprised that you once again want to keep what isn't yours, and do so regardless of who you hurt, even if those people only supported and helped you (by actions or loans)? And you even went out of your way to lie and do so?

No they probably won't. Because your a bankrupt (in all ways) pathetic loser and

that type of action is not uncommon of worthless flotsam.

Oh, by the way...one of many reasons you should do what you asked and then agreed to the court to do..is it's real clearly probably illegal not to. Of course, you don't care about things like that, you only care about what will happen to you!

If the Chapter 13 Bankruptcy is still active you probably will need to turn over this to the Chapter 13 Trustee. At the least you need to ask the Trustee about the refund amount and if it must be submitted or not.

No! You must claim more dependants on your paycheck to avoid the trustee claiming your refund. 1500$ is the limit from Fed and State combined. Keep your refund below that amount combined and you will be in the clear. I find it ironic that if you owe the irs any money the trustee does not help out with that but if your refund is good then the trustee will claim it. Hope this helps!

I spoke to my lawyer about it and he said that he has never know the trustee to take the refund in this district. I would advise you to talk with your lawyer, I am sure your case wasnt his first and they should have a history with the trustee.

No they do not take your refund from my experience, but they do take the state refund. If they do take it, you can contact the trustee and ask for it back. I was told as long as the payments were being made every pay period we were okay. Hope this helps
