Because the plant needs to use energy to live, and if the plant uses up the energy the herbivores can not receive it. There for some of the energy is used for the plant and what ever is left over is received by the herbivore.

Most energy obtained through chemical reaction by plants are used up for growth and maintenance of the plant. Moreover, there is also loss of heat when the plant uses the energy which makes only a limited amount of energy to be available to the consumer.
