Regardless of what is said about them Lawyers are very useful people. If you're sure the mother of your child is a drug addict, you can have your lawyer advise OCS of this demanding they put in frequent welfare checks on the children and mother and make recommendations that the child be put into the custody of another (clean and sober) member of the family or even into foster care.

An other method is have family check in with the mother and your children frequently (if allowed) with the admonition to call the police at the first and every sign of drug or alcohol abuse. Or to at least talk her into letting the kids "stay the night" when she's on a runner. It's very important to be a friend of this addict so that she'll know it's concern and not vengeance the family is doing this over. Concern for her especially. Emphasize you want your kids away from the dope, not their mother.

If a father of a child has a felony on their background does that lower the chances of winning joint custody?

The father's felony conviction will most likely come up during the custody case. However, the courts will look at evidence of the circumstance surrounding the conviction, and also whether the father has changed, and is rehabilitated.

If the father has drug felony he can still get child custody?

As opposed to a violent mother? If he's cleaned up his act, yes.

If you are a divorced mother dating a nonviolent felon can his presence threaten her custody of children?

What is a nonviolent felon? Are you asking, Is it all right to date a felon as long as he only shows my kids how to steal? Or is the father saying he doesn't approve of your boyfriend and the only thing he has against him is a felony conviction? The father won't get far unless he has more than merely a felony conviction.

If your boyfriend lives with you and you have custody of your children can your ex take custody if your boyfriend has been convicted of a felony?

It isn't automatic, but because of your living arrangement and association with a known criminal it certainly could be grounds for filing a motion to re-open the custody arrangement.

What might happen to minor children who are US citizens if their father is convicted of a criminal felony and deported?

They could be placed in the custody of relatives who are legal US residents or made "wards of the court" and placed in a foster or group home in the state where they now reside.

Will my son's biological father's girlfrend's felony conviction hurt his custody case?

If she lives with you it sure could, especially if the child's father is fighting her for custody of the child. He will use your criminal background as evidence of the child being around a "bad influence."

Can an ex husband take his kids away from their mother if the step father had a felony long before he met their mother and is now a great step father?

This is a matter of child custody and is in the power of the courts, subject in part to any divorce decree or agreement. The court can do most anything that it decides is in the best interest f the children.

Convicted felony can you get your rights back?

Youll have to be more specific. What 'rights' you are referring to? What are the ages of the children? Who has primary custody of them while you are (presumably) in prison?

Is it possible for a father that has a history of abuse and a felony on his record to gain any type of custody?

if its taken to court and the mother has a clean record she will most likely get custody of the child and if the father does not pay child support he has no rights at all..(im going though this same thing in court) about the only way he can is if he proves that the mother is unfit

Can you be wrote a ticket for a class D felony in Arkansas?

No. Felony offenses require a summary arrest (i.e.: taking you into custody).

Do you have a lesser chance of getting custody of your child if you have a felony on your record?

You don't necessarily have a lesser chance of gaining custody of a child if you have a felony on your record. It depends on the circumstances of the felony and on the history, criminal and other, of the parent applying for custody. One thing you can do is you can try to get your criminal record expunged, and that way you will have better chances of winning custody. Anyone eligible for expungement should do this, since it will significantly improve their chances of getting a job or a student loan, as well as improving their opportunities in other areas. Good luck!
