The moving car is at fault. Say you parked on a hill and asked someone to look under the car then put it in neutral. The car rolled and they were injured. Do you really think because you were no longer in a car that they could not charge you. Of course this is minor and what caused the car to roll is not stated. If the car was in park or not on an incline it should not roll.
As long as the parked vehicle is parked properly and not illegally parked in any manner, then the vehicle that rear-ended the parked car is at fault. Now if the parked car is sitting illegally (such as double parked or parked in a no parking zone, etc.) then the parked car is at fault or even both the parked car AND the car that hits it are BOTH at fault.
