Sounds like it wasn't discharged, otherwise there would be no payments after bk. Thus the bk is irrelevant, they can repo. I don't know the specifics of your case, but GENERALLY only unsecured debt goes bye bye. A car loan is secured (by the car) With all your bills gone, it should make it easier to pay to keep it. Check your paperwork & speak with your rep though-(1) was in included at all (2) Read disposition for any exclusions (like the car)

I brought a car for my girlfriend daughterI filed for bankruptcy which I was discharge.I put the car down on the form to keep for her to keep making payments but she stop and the car is in her name.?

Open Bankruptcy means that your petition has been filed, but you have not yet received your discharge papers. The discharge papers officially relieve you of your debt.

We filed chapter 7 bankruptcy. When can the bank take the house?

When you either voluntarily give up the house or you stop making payments (foreclosure).

You kept making car payments after discharged in chapter 7 if you stop paying and don't surrender the car can the lender go and undo your bankruptcy?

No. But, the vehicle will become a repossession if payments are not made.

How do you get lenders to stop harassing you about payments during foreclosure?

You need to contact your attorney about having them stop. There is no law unless you have declared bankruptcy that they have to stop.

My bankruptcy was discharged I brought a car for my friends daughter and she was making the paymentnow she stop what happens to the car it's been 6 month and nobody looking for it.what to do?

Your bankruptcy was not discharged, unless it was thrown out of court. Your debts were discharged. You can keep making the payments, find somebody who will take the car and make the payments, or call the lender to make a "voluntary repossession." You will then learn what a dumb move it was to buy the car, since you will be liable for any deficiency and you cannot file c. 7 again for 8 years.

If a car was not included in your bankruptcy but you later change your mind and decide to stop making payments can the lender have a judgment issues for the balance?

I DO NOT KNOW WHAT STATE YOU ARE FROM OR WHAT ATTORNEY YOU HAD. I KNOW MY CAR WAS LISTED AND I MADE PAYMENTS... BUT I KNOW THAT IF I MISSED PAYMENTS, THEY WOULD TAKE MY CAR... SO,NO...IT IS ILLEGAL FOR THEM TO ASK YOU FOR ANY PAYMENTS AT ALL. HOPE IT HELPS?!

Can you keep property if a motion for relief from automatic stay is not granted?

Yes, so long as you keep making the mortgage payments. If you stop paying, eventually the creditor will be allowed to foreclose on the property.

What if you have filed bankruptcy without a reaffirmation letter on the vehicle and you stop making car payments for two months. The leinholder sends no repo letter and does not come to get the auto.?

Yhe lender cant do everything at once, they will get around to you and your car.

When do you file bankruptcy letter of intent?

You should file a bankruptcy letter of intent as soon as possible so that your creditors will be on notice. This will stop the harassing calls and foreclosure proceedings if you are behind in your mortgage payments.

If your vehicle was listed in your Chapter 7 bankruptcy almost a year ago and the bankruptcy has been discharged and you are current on your payments can you still turn it in?

Yes you can still turn it in. They told me that because it was involved in the bankruptcy, I could stop paying at any time and either call them to come get it or take it to the nearest dealer. I chose to keep my vehicle at the time but have since traded in for another.

If your credit report indicates that your car loan was cleared by bankruptcy can you stop making payments?

Nan, why not ask your B/K attorney?? S/he is more familiar with your case than anyone else. The fact that you "thought" you reaffirmed indicates a possibility that you didnt.

What are the consequences if a person quits making payments and the car is in your name?

If your name is the borrower name and someone else is making payments and they suddenly stop; then the car will eventually get repoed and it will show on your credit report.
