The landlord has an obligation to return the deposit to somebody. He wouldn't be wrong to return it to the boyfriend, but he could also return it to you. Then, if either of you feels aggrieved, they could sue in small claims court.

Can a Manager or Landlord Wrongful withhold part of a security deposit even if you never moved in?

If an apartment is reserved for you, because you paid a security deposit, that means that the landlord is not able to rent it to anyone else. Hence, when you then decide not to move in after all, the landlord has still lost the rent which he might have collected by renting that apartmnent to a different renter. So yes, he can withhold the deposit. It is not a good idea to make a deposit on an apartment that you are not actually going to move into.

Which type of deposit is paid in advance to protect landlords against nonpayments?

security deposit

How can a landlord keep my security deposit if don't move in?

It's quite simple: once the lease is mutually signed, something that is normally done after a security deposit has been paid, then the tenant is considered to have legal custody of the property or dwelling. If at that point the tenant does not move in, the security deposit can be kept. This is because the apartment has been rented out and if at the last minute the tenant decides not to move in, then the landlord has to try to rent out the apartment, which may remain vacant until this happens. It should also be noted that the tenant would also be responsible for any rent of the apartment while the apartment is still vacant and up to the remainder of the lease term.

Can landlord keep security deposit when you take in a stray cat?

Most landlords require a "pet deposit" in addition to your initial security deposit. So, if you get a cat, without permission from your landlord, then yes, they can deduct from your security deposit, the amount that you would have paid for the pet deposit. Also, they may be able to evict you, if they find out you have an unauthorized pet.

Does the landlord have to give back security deposit if tenant refuses to sign lease but moves in?

Normally a security deposit is paid before the lease is signed. Once your lease is mutually signed then you have the right to move in.

Do you put a Security Deposit on the Balance Sheet?

Yes. If it is a deposit paid to a vendor, then it will be classified as an asset. If it is a deposit received from a customer, then it is a liability. Depending on when it is expected to be returned, you will classify it as either current or non-current.

If you hold a security deposit on sept27 and today the tenant comes and tells you they don't want the apartment for November do they have the right to get all the deposit back?

If you held the deposit since September 27th and the prospective tenant returned in November and said they didn't want to keep it, you may hold the deposit. Now, this assumes that your deposit was for FIRST MONTH of rent only. If they paid a $500 deposit and your rent was $250, you must return the other $250 back to the tenant. It would be assumed that the lease was to commence October 1st, that would be Oct to Nov as one month.

Can an apartment complex charge you more damage fees upon moving out after they have already charged a non refundable fee?

Do down payments and security deposits that have to be paid up front on an asset have a major influence on the lease or loan option?

For down payments absolutely. Any money pre-paid on an asset that will be purchased with either lease or loan, will reduce the total debt due. This reduces the monthly obligation (cash going out) and reduces the total interest amount paid over the duration of the loan. A security deposit is completely the opposite. The money paid into a security deposit accumulates interest money for them, not you. It also doesn't reduce your debt to them so you pay more in interest. You will also pay more per month because the total due is higher. I have never paid money into a security deposit in 40 years of business and never would. I have however paid 50% or more towards a down payment.

I am looking to rent an apartment. My boyfriend has okay credit and I have a credit score of 490 is it better to apply with both of us because the income would be higher or better to keep me off?

Unfortunately in this world a lot of rental places want anyone over the age of 18 to fill an application. If they find out that you are living in the apartment they will seek action/or evict the tenant. Please be aware that it is a lot better to have the both of you fill out a application. Just make sure that your prior evictions if you have any are paid off. This will benefit you in the end and be assured that you will most likely get the apartment (maybe with restrictions like a higher security deposit and a months rent ahead of time).
