In contrast: Suppose you have a rotted tree in your front yard. Limbs have fallen and litter your property, which is not well maintained, and it is obvious the tree is in a deteriorated condition. Now suppose a child riding by on a bicycle is seriously injured by a falling, rotted branch. That would not be considered an "Act of God" and you would be held personally liable for the damages.
