In Minnesota our builder unilaterally changed the windows in our new home construction - what recourse do we have when the builder refuses to put in the windows they promised?
You can sue him for breach of contract if the type of windows are specified in the contract. Some builders will switch them to the correct ones with a strongly worded letter from yourself and/or an attorney. Send it to his office, be polite, respectful, but stand your ground (no profanities or ramblings or rants about other problems unless they are cited as further proof he has not followed the contract), copy the contract, HIGHLIGHT what was listed in there, then take pics of what was PUT in instead, have your signatures notarized, make 2 copies (notarize them both at the same time) mail his copy to his office; return receipt/certified or registered mail. Keep ALL receipts and the signature card you get back. This shows him you are NOT messing around. I have also always found that adding (after your closing and signature and before your notary block) a CC: and then listing an attorney you know (or google big breach of contract lawyers for your area and through that name in there) or your actual lawyer and making sure you put Attorney Jim Jones or Jim Jones, Attorney at law usually does you wonders ;)
