Traditionally, a contract is formed when an offer is made and accepted. There must also be valid consideration, something given. If you sign a contract to borrow money, the lender gives the loan of money; the borrower in return gives his promise to pay. Contracts can also be implied by conduct, but this is much trickier to prove and enforce.
