It depends on which version of the myths you read. In the oldest versions, Daedalus was a Cretan, a loyal subject of Minos. After the fall of the Minoans and the rise of the Hellenes, The story was retold with Daedalus being Athenian-born, the son of a previous king who fled after an unfortunate murder. In any event, the "escape" from Crete was an invention of the Hellenes and even later people, who cite Daedalus as having lived for a time in Sicily and Cumae. Even later versions of his life state that he killed a rival named Perdix, who was his nephew (Athena turned poor Perdix into a Partridge out of pity), and that was why he left Athens in the first place.
Daedalus was in prison at the beging of the story

Icarus was not a Greek god. He was the son of Daedalus, in the myth, Daedalus and Icarus were forced to flee from the king of Crete, Daedalus crafted wings, made with wax, he warned Icarus not to fly to low or to high. But he did indeed fly to high, the wax melted and he fell into the sea. All in all a sad myth. There was also another story about Daedalus, Talus also referred to as Perdix, his nephew and his apprentice was a threat, he was talented, and in a desperate attempt Daedalus caused him to fall towards the sea, but the goddess Athena saved Talus by turning him into a bird who was able to fly away.
