It depends on what you are downloading. Some things are actually free.
If you are talking about songs, it is because the artists give the record company rights to sell their songs and their product, and the record company has to sell the rights to sell the song to companies such as Apple (iTunes) and Napster. The record company and the artists intended to sell the music, not hand it out for free.
Their songs being sold is their paycheck to the artists. If you get their song for free, you are basically taking away money from the artists' pockets.
It is basically all about the rights of the seller. The seller is selling the song for money, and getting it for free is stealing since every person must have purchased the song so they are allowed to use it for their own entertainment.
