There are Federal Laws prohibiting the recording of conversations unless at least one of the people in the conversation has consented to being recorded. Minnesota might have additional requirements, but definitely don't record a conversation unless you're in the conversation too, or someone in the conversation said it was ok.

As long as at least one of the parties to the conversation knows it is being taped then it is legal to tape the conversation. If a third person is taping the conversation but not involved in it and does not tell those involved in it that they are taping it that is illegal.

There is no law anywhere so far as I am aware that says you may not record your own 'phone calls

Another View: The above contributor is mistaken. The laws of all states are NOT similar. While some require only one-party knowledge - others require that both parties be notified, and still others, that ALL parties to the call be notified of recording. Further, if you make an interstate call into a state whose law differs from yours, the call is governed by the law of the state(s) INTO which you are calling.

That would only be illegal if all parties were in one of the few two-party consent states in the USA (about 12 of them).

The statute in Minnesota, like MOST states, however, makes it a one-party state, meaning that anyone who is actually involved in the conversation, or who has given someone ELSE consent ("one party consents") may record the entire conversation without anyone else knowing, let alone consenting.

So, to answer your question, "one party" does not know, but the other party does, which makes it legal.
