It is legal to smoke at any age in the UK, however there are restrictions on how a child can obtain tobacco products and where they can be smoked.
It is a criminal offence under the Children and Young Persons (Sale of Tobacco etc.) Order 2007 for a child (defined as any person under 18 years of age) to purchase any tobacco product, including ancillary products such as filters and rolling papers. It is is also an offence under the same act to purchase tobacco products for a child.
If a child is seen smoking in a public place, Police Officers, PCSOs and other accredited persons have the legal power under the Child and Young Persons Act 1933 to seize the child's tobacco products if they believe them to be under 16 years of age. However the child is not committing an offence.
