Merklinger is facing criminal trial in Colorado shortly. Seems he never bothered to tell anyone that he did 4 years in federal prison back in the 90's for attempting to con the US government out of $39,000,000. He is new criminal charges these days. What a slieze bag.

This is his moment of cause and effect, karma or also known as "The GOLDEN RULE". One would think the older we get the more we learn from our past mistakes. We are all entitled to a mistake, however if we commit the same crime of stealing twice that is a pattern. Mr. Merklinger is a two time convicted felon now. Be warned of this if asked to donate or invest with this person.

Recently a friend of ours decided to post his feelings about "whatever happened to Alex Merklinger". Because there is so much to the story that hasn't been exposed, I am compelled to finally give a more complete accounting, starting at the beginning of the cascading series of events leading to Alex's imprisonment.

My husband, Alex Merklinger, went to a small private preparatory school in NJ. Many of his classmates were from well-placed and influential families from the U.S, Europe and South America. From his acquaintance with a family of brokers in the shipping business came the opportunity to broker an oil transaction with Indonesia. Another friendship with a Brazilian dignitary resulted in his brokering a successful loan to Brazil from the U.S.

It was following those years that Alex and I were introduced to each other by a mutual friend who published a magazine in Denver. I was on the cover and Alex was the feature story. We were married in 1981 and spent a "honeymoon" visiting a woman whose husband had been an assistant to Nikola Tesla; an interesting fact, but not relevant to my story.

During the early 80's, Alex's contacts and business dealings in a rather small and exclusive circle of money and oil traders had earned him a distinguished reputation. He was asked to broker a large transaction between the U.S. and a Trust of the 5 largest oil-producing countries of the Middle East. The venture/adventure was underway. We spent quite some time in Europe, namely England and Switzerland. Because of the big numbers (which I am reluctant to divulge) and very secret meetings, we found ourselves in the midst of high level intrigue and espionage. Working directly under Reagan and his administration, this transaction would have relieved the U.S. of its debt (at that time, not an insurmountable figure compared to what it is today). To briefly summarize, Alex was warned by some high level government officials that his future would be at risk if he continued with his efforts to complete the transaction. It would not have benefitted certain factions to have the transaction be successful. In spite of the death threats to Alex (and me, indirectly), he carried on.

There were low level brokers who tried to insert themselves into the situation; I do not know who was responsible, but there were murders of a couple of those men, as well as a banker.

Alex's contact with the Trust was Franz-Josef Giehl, (not sure of the spelling) who had been the pilot for the King of Kuwait. Giehl had been entrusted with that position as a reward for an earlier heroic deed. There was a plane crash in which Giehl lost his leg as he rescued the King's son from the fiery crash. Alex worked under the direction of Prince Fahd of Saudia Arabia, later to become King Fahd.

After returning to the U.S., it became apparent that Alex would be flagged as someone who ruffled feathers which ought not to be ruffled. He established a trust company and began to work on providing surety bonds for minority contractors. He was approached by a businessman who expressed a desire to with Alex on the bonds. After working out the arrangements, Alex signed a small number of applications for the fellow to provide to prospective contractors. Time passed, a couple of the bonds were successfully enacted. However, we were later to learn that this fellow had forged Alex's name on hundreds more applications, distributed the applications and collected substantial fees from contractors who were not qualified. The failed bonds were left to be collected by Alex's trust company. The assets in the trust company would have been sufficient to cover the bonds, but one of the sources of assets claimed that his assets had been withdrawn. The document provided by the source to back his claim proved to have been forged, as it turned out. That trial showed Alex to be innocent, because.......in a quirky twist of fate, we happened to find the original and UNALTERED agreement where it had fallen behind the file cabinet drawer, even though the office had been thoroughly ransacked by federal investigators. Nevertheless, the government was now madder and hotter than ever to prosecute Alex.

There were 4 trials; two where charges were dismissed, one where he was found innocent, and one, after several years and destruction of our ability to defend ourselves, in which he was found guilty of wire fraud, among other things. Interestingly, the trial had been moved from Memphis, a sophisticated metropolis where he might actually have received a fair trial with a jury of true peers, to Jackson, TN, where the federal government had NEVER lost a trial. Had they failed to get a conviction in this last trial, they would have continued with the proceedings they had already initiated in Texas, Hawaii and in Alaska, knowing we could not afford to bring witnesses there, nor would a public defender have been competent to handle such a complicated case. Had things gotten to that point, since we were pretty much broke, Alex would have been incarcerated and transported by the feds. This is called "diesel therapy" and is known to keep a prisoner on the move from place to place for months with no contact with family or the outside. He had also been told by an attorney that an FBI agent had said to him, "I don't know who your client has p*ssed off in the government, but they're out to nail his a**".

Alex spend 37 months in a federal prison.

(I have failed to mention that Alex had become recognized much earlier as a pioneer in the field of expansion of consciousness, metaphysics, spiritual development and techniques of using one's higher abilities. During those years when he was actively teaching, he was quite well known. He taught across the U.S., Mexico, Canada and Europe. My point being that he had become a public figure and one considered to be controversial because what he taught was, at that time, quite progressive and not universally accepted.) His bio will follow this article.

As years passed, Alex continued to teach but also continued to pursue the elusive international money trading. He worked on transactions in which the participants were at the multi-million dollar level. He also hosted a radio and Internet talk show called "Mysteries of the Mind", which I produced. The show was listened to by over half a million people in the United States and in 72 countries that we knew of. One of Alex's listeners, Brian McCarthy, became a student in one of the Mind Development classes and asked Alex if he could participate in one of the financial transactions, since he had recently inherited money from his father's estate. Many of you who are reading this have also read much of Brian's rants on the Internet, but we will address that in a moment. Alex explained that Brian did not have sufficient funds to be a participant, but if he wished, he could receive a small percentage of the commissions Alex expected to receive on two transactions. Here is an actual copy of that agreement.

In spite of the diligence Alex applied to the transactions, they failed. Over time, since we were not able to return Brian's funds, he became irate, threatening Alex's life, smearing Alex and myself on the Internet, and, finally, after failing to get the Colorado and New Mexico Attorneys General to file charges against Alex, managed to get an Assistant District Attorney in Colorado Springs to charge Alex with Securities Fraud.

All this took place over almost a 3 year period. Meanwhile, Alex's health had deteriorated due to heart problems. McCarthy concluded somehow that Alex's health issues were just a "story", so I will elaborate: 1) two heart attacks, 2) implant of 2 stents to hold open arteries, 3) quintuple bypass, 4) large blood clot inside the heart, 5) one episode of cardiac arrest, 6) ventricular tachycardia, 7) implant of pacemaker/defibrillator, and 8) broken wire to the pacemaker/defibrillator, requiring replacement of the entire unit, after which it was discovered the pacemaker had not been turned on.

To complicate matters even further, we were faced with the long, drawn out saga of his daughter's (my stepdaughter) battle with cancer. She died in 2007. Then we were away from home to give support to my Mother as my Father declined into dementia. He passed away in 2008. During our absence, our cabin was burglarized. Our electronics, cameras and my jewelry were stolen. Eventually, we lost our land and the cabin we had built ourselves.

The prosecuting attorneys decided to offer a deal. If we could come up with the money designated as restitution, there would be no trial, no jail time, just a probationary period. In the six months we were allotted to raise the money, we failed to find any source of support. No wonder! Brian McCarthy had emailed all of Alex's business contacts and told them not to do business with Alex. Finally came the date for pre-trial. Because I was ready for an emotional meltdown from the years of stress, because a trial date would be another six months out, because the description of "securities fraud" was extremely ambiguous, and because the State intended to call a securities fraud prosecutor as their witness, we considered the high risk of a trial and what options remained. We decided to accept the plea bargain to a lesser charge, not realizing the sentence for the lesser charge was the same as for securities fraud. Alex pled no contest to a charge of theft of "no less than $10K and no more than $20K". The judge deemed Alex's earlier conviction relevant and sentenced him to 4 years. Brian has claimed that Alex was convicted of securities fraud, but that is untrue.

Now, does it seem to you that the one page document, clearly a simple agreement between two people, can reasonably be the basis for criminal charges? It could have (and should have) been presented as a civil case: breach of contract perhaps. What is glaringly evident is that the whole case pursued by McCarthy was about the money and revenge, considering it would have quietly disappeared if we could have raised the money. And how was Alex supposed to have done that OR CONDUCTED ANY SORT OF BUSINESS after what McCarthy had done to Alex's business relationships?

You should know to what extent Brian McCarthy, whose words have been plastered all over the Internet and whose voice has been heard on radio, has gone to secure revenge. He not only sent emails to Alex's contacts, but he created email accounts in my name, Alex's name and in the name of some of our friends. In fact, he created an account in the name of a dear friend of ours who had died just three weeks prior, but McCarthy didn't know that. Sending some of those as if they came from his false accounts identities, he spread vicious and disgusting emails to our families and friends. He even sent one to my parents, as if it was from me, which drove my father into a further tailspin of saddened confusion.

All of the information I have written about is well documented and kept on file.
