Info on obtaining a Certificate of No Impediment to Marriage (Legal Capacity)
Documents to be submitted with the application.
Introduce yourself in person at the Embassy with your future (e) married (x) to submit the necessary documents.
The certificate may be requested every Tuesday and Thursday between 11:00 and noon.
It is recommended to be present at the Embassy in 10:45, so as not to be late. An appointment is not necessary.
The following documents must be submitted by the Belgian partner:
1. a copy of your birth certificate (*)
2. a complete preview of population registers in your home in Belgium that mention your full name, your home, your nationality, your marital status.
3. a sworn statement ( click here )
4. if you do not live in Belgium, you must also submit a certificate of civil status issued by the competent authorities of your current residence
5. If the point 2 reveals that you are divorced or widowed, you will need, besides the sworn statement covering the subsequent period, provide any documentary evidence relating to your divorce or the death of your (ex) spouse ( *)
Ø (*) These documents must be certified by the issuing authority and date of less than 6 months.
Ø to the Belgian Embassy in a translation is not required
Ø A single copy of all original documents is required + to + the identity card of the passport. The original documents will be given .
Procedure.
The registrar must be attentive to the issue of bogus marriages (art. 146 bis CC) and / or forced (art. 146 CC).
The Embassy will submit the request to the FPS Foreign Affairs in Brussels service family law and marital status.
If the FPS Foreign Affairs notes the suspicion of a case of simulated or forced marriage , the entire file will be transferred to the Public Prosecutor of the place of residence in Belgium of the applicant, inviting him to investigate further and its opinion.
Pending the opinion of Mr. Attorney of the King, the issuance of the certificate shall be postponed.
If a set of complete and valid documents are submitted and if there is no hint of a simulated or forced marriage :
Ø Tuesday, the certificate will be issued on Friday the same week
Ø Thursday, the certificate will be issued on Tuesday the following week
