Each state is different. In the state of Florida the adjudication of guilt MUST be withheld. After you have completed your sentence, whether it be probation or jail time, you will be eligible to apply to have your record sealed. If you would like it expunged the state attorney's office must sign off on it.

You can get a felony expunged from your record if the charge was dismissed, the grand jury refuses to indict, or if you are arrested but not charged. A record may also be expunged in return for completing certain pre-trial diversion programs. Tennessee does not appear to allow crimes for which you were convicted to be expunged.
