In a divorce when the man gets usufruct of the property and the the wife gets half mineral rights who has control of the mineral rights as to how much will be collected?

The wife would have the right to grant mineral lease, receive bonus/rental money & potential royalties on her undivided 50% interest and the husband could do same with his 50% interest. The rights are owned separately and each party can do as they wish.If the usufruct is over the mineral rights and not only the surface, the situation would be different. Is there a usufruct over easement?

Usufruct is the legal right to use property that belongs to another person or entity. In many legal usufruct systems of property individuals or groups may only acquire the usufruct of the property, not legal land ownership. You need to review the language in the instrument that created the easement to determine if the affected land can be used for other purposes. If you are the person to whom the easement was granted your use of the land encumbered by the easement is generally restricted to the use defined in the easement. If you granted the easement to another party the easement agreement may prohibit certain uses of the land encumbered by the easement.

Does the government in China allow private ownership of real property?

There is no system for private land ownership in China. The state took control of all the land during the Communist takeover in 1949. Communist Party officials control land usage rights. Private ownership is a new concept for the Chinese and they have little legal structure for or practical experience in private land ownership. China has recently commenced the development of a civil code that allows property usage rights based on the civil law concept of usufruct. Usufruct is the legal right to the use, profit and benefit from land owned by another. The government has caused unrest in the last few years by transferring lands to developers who, with inadequate compensation, oust city dwellers from their homes and farmers from their lands and means of livelihood. There has been a groundswell of resistance where city dwellers have protested and farmers have divided collective land amongst themselves claiming private ownership of their family farms. You can read more about it at the links below.
