Generally, a land contract, or contract for deed, is an installment contract for the purchase of land. Bank financing is not involved. The seller finances the sale and retains ownership of the property until the price has been paid. The buyer makes installment payments and when the land has been paid in full the seller should record the deed. If a bank was involved in the transaction the bank would require that title be transferred to the borrower.

The problem with this type of transaction is that title is not established in the buyer as it would be in a normal sale. The buyer must rely on the seller to maintain title to the property without incurring any further encumbrances and transfer it once the full purchase price has been paid.

If the land has been paid in full and the seller has not recorded or will not record the deed you will need to speak with an attorney in your area about judicial remedies under your particular state laws. You will need to provide proof that the land has been paid for as agreed in your contract. You should address this situation ASAP.

What if i got a motorcycle but the seller nevr sent me the title?

If you get a motorcycle but the seller never sends you the title, you should contact the seller. If the seller still does not give you the title, you should take the seller to court. The seller is obligated to provide you with a valid title so that you can register the car.

Where does seller sign on North Carolina car title?

A seller should never sign except in the presence of a notary. A notary has to witness the seller signing his/her name. Notaries have to take special classes in how those type of documents need to be filled out

Is a futures contract a type of options contract where you are either a seller of a call or a seller of a put?

A futures contract is different from an option contract: an option contract allows the buyer to choose to exercise the contract. A futures contract obligates you to do it. Example: You and I decide to buy calls on 100 shares of Acme stock at 22 with June 1 settlement date. You buy a futures contract, and I get an option contract. On May 27, Acme drops to 10 and stays there. On June 1, you must buy 100 shares of $10 stock for $22 per share. My option is out of the money, and I never exercise it. The "obligation" part explains why futures contracts on stock are very, very rare. Almost all futures contracts are written against commodities.

If the installment contract had inadvertently not been signed by the seller and the buyer wants out after three days is this a sufficient loophole for a used car contract?

The dealer typically never signs the contract when the customer does. The dealer principal does quite often. Sorry this is not a loophole, its still a binding contract. However if you signed an open contract where it doesn't say what bank anywhere on the contract its assigned to then a very good lawyer can help you. Sometimes dealers can have you sign a contact without getting an approval from a bank first so they can leave that part out for them to hand write it in later.

How long is a seller obligated to pay commission to a real estate agent after their contract has expired before you can sell to someone new that the realtor had no communication with?

I would hope this was covered in the contract you signed. There is usually a protection period but it extends only to buyers that looked while listed with the brokerage. If your buyer has never seen the house and your contract has legally ended, you are free to sell right away.

How do you apply for a title if a title was never issued?

If a title was never issued, how did you get the car? Every vehicle starts out with a manufacturer's certificate that can be traced. It should be possible to trace the first sale of that vehicle. If it was a legal sale and that owner never got a title and sold you the car, you should be able to contact the appropriate governmental entity and get a title. Normally when you purchase a car that has been a lease and never had a title issued, the seller has all the legal documents that you need to get the title. Frequently, you paid a fee for the seller to get you the title.

When does finlays contract expire?

How can you get a title for a car if you bought it with no title?

Go to your local DMV with the seller in tow, and ask for a duplicate title. You may end up in a mess here as you should have never bought a car without the seller providing the title. You have no proof you even own the car unless the seller is honest. Filing for a storage lien is how you may proceed to acquire title without trying to get ahold of the seller in tow. Ask for the forms at the DMV.

Can a proposal become a contract?

Yes, if the proposal contains an offer to contract, and that offer is accepted by the other party, and the contract meets all the other legal criteria for enforceability. You should never offer a proposal if you don't want to be bound by the contact that it would create when it is accepted.

What is the best place to buy a horse in Alberta?

Just look in the pets section under livestock, that is one place where horses are sold in Alberta, Canada. However, you should never send money through PayPal, you should always pay in person after a contract of sell has been signed by the seller. Always buy the horse in person to avoid being scammed. You should ask for current veterinarian records as well to make sure the horse is healthy.
