Due to human factors, the actual 'swearing in' might vary, but the official change over from one President to the next takes place at Noon on the 20th of January as stated in the 20th Amendment to the Constitution. This happens regardless of when the ceremony is performed and even if it does not take place by Noon on January 20th. However, the incoming President must take his or her oath of office prior to acting in the capacity of President.
Article II, Section 1, Clause 7 of the Constitution requires that before the president enters upon the execution of the office, the following oath must be made:
"I do solemnly swear (or affirm) that I will faithfully execute the office of the President of the United States, and will to the best of my ability, preserve, protect and defend the Constitution of the United States."
President Obama was sworn in for his first term on January 20, 2009 at about 12 noon Eastern Time (give or take a few minutes). He won re-election on November 6, 2012, and will be inaugurated on January 20, 2013.
