In 1922, the former Postmaster General Will H. Hays was appointed the President of the Motion Picture Produces and Distributors of America (MPPDA). The Hays Code (The Motion Picture Production Code of 1930) was formed. It was "A Code to Govern the Making of Talking, Synchronized and Silent Motion Pictures. Formulated and formally adopted by The Association of Motion Picture Producers, Inc. and The Motion Picture Producers and Distributors of America, Inc. in March 1930. " Certain subjects were absolutely taboo: Homosexuality, rape as a plot device, drug abuse, prostititution. Interestingly anything resembling comedy regarding ministers of religion was totally off-base. There was a good deal of oversight. Some pictures used cuts (omitted material and then thought-jumps to conclusions, which often baffled audiences. Examples included Riders on the storm, which sounded like a Western. There is a gap between the gathering of off-duty soldiers in the Paris hotel (actually a brothel) and the intimation that one of the girls is, well, in an occupation banned by the code.)
Just before the 79th Academy Awards in 2007, the Academy of Motion Picture Arts and Sciences ruled that only one producer (Graham King) would be eligible to win the 2006 Best Picture Oscar for "The Departed." The ruling eliminated producers Brad Pitt and Brad Grey from accepting awards. In 2000, the Academy adopted stringent rules limiting the number of officially credited producers to three. In the case of "The Departed," King's participation was considered to be more instrumental to the film that the other producers.

Producers are nominated for Best Picture. But not every credited producer is nominated, there's a limit of four people, so sometimes an executive producer might not get nominated even though the movie is up for Best Picture.
There is no Academy Award for Best Producer, but Oscars for Best Picture are presented to specific producers of the winning film. On February 24, 2013, Oscars went to producers Grant Heslov, George Clooney and Ben Affleck for their 2012 drama "Argo."
