The actual language authorizing the creation of a federal is provided in Article One, Section Eight, of the United States Constitution, which permits a "District (not exceeding ten miles square) as may, by cession of particular states, and the acceptance of Congress, become the seat of the government of the United States"
Originally The Commonwealth of Virginia and the State of Maryland both ceded land, and the original size of the federal capital was 100 square miles (or 10 miles square). However, in 1846 the land provided by the Commonwealth of Virginia was retroceded and no longer part of the capital.
