I believe you would need to call the office where your marriage license was issued, and ask them about the laws in your state. In some states you would still be married, regardless of the SNAFU. I had this happen - and the lady at the office in the courthouse said "If you intended on getting married - you're married." So, yes, I had to have an attorney and the whole works. If you are not legally married, you cannot get divorced. However, a technical error with the marriage license may not necessarily mean you are not legally married. It may be still legal, or you may be common law married. If you are not legally married, you can still file a civil suit for the dissolution of property.
In places where it has been legalized, it happens exactly the same way as any other marriage (i.e., apply for marriage license, ceremony before authorized officiant, registration of marriage, issuance of certificate). In places where it has not been legalized, it does not happen except symbolically.

If you are living with someone that might qualilfy as a common-law marriage even if you never took out a marriage license. If you are just lying, you might still get away with it; the IRS doesn't have the time to investigate every detail of every income tax form that they receive. If you happen to be caught, however, then yes, you will be penalized.
It can very well be annuled if the papers are not correct and no priest or marriage license . issued. In California, I believe the reasons for granting an annulment are: * Fraud (Like, if someone says they want to have kids and then they say they don't); * Insanity (If one is committed to a menatl institution); and * If the marriage was unconsummated (If you never had sex). Oh, and if you happen to belong to the Kennedy family, all you need to do is ask for one : )
The NY marriage is not valid. You can also be prosecuted for bigamy, if they wanted to go that route.
