The use of patents began in England in the mid-sixteenth century as a way to induce outsiders to bring new technologies into England. The Crown granted time-limited, exclusive privileges to the inventors by means of letters patent. It was believed that by attracting inventors into England, the community would gain from the new technologies. Our Founding Fathers adopted the patent process from England with similar goals in mind. According to Article I, Section 8, Congress is "to promote the Progress of Science and the useful Arts, by securing for limited Times to Authors and Inventors the exclusive right to their respective Writings and Discoveries." Because the U.S. Constitution set out that inventors were to be protected from corporate exploitation, we now have laws which outline what qualifies for a patent. The first such laws were enacted around 1790 and were revised in July of 1952. This revision is known as Title 35, the United States Code. However, the existence of the United States Patent and Trademark Office (PTO) only dates from 1802, at which time the first "Superintendent of Patents" took office. Several revisions of law took place in 1836, 1849, and in 1925. These revisions changed the name of the head official, and transferred the PTO from the Department of State, to the Department of Interior, and then to the Department of Commerce.

What is the difference between an issued patent and a published patent?

A published patent refers to the publication of a patent application, which is be reviewed by the Patent Authority (USPTO, EPO, JPTO, etc.). Once the merits of the application are acknowledged by the Examiner, process which takes from about to 2 to 4 years, the patent is granted (issued). The difference is that a patent application does not protect the inventor from any potential infraction to his/her inventive matter, and the inventor is allowed to start civil actions against the infractor, only once the patent is granted.

What do you do with your invention idea?

If you have an idea for an invention, you can try to patent it. This is a complicated process and is not free, so you should consult a patent attorney. In parallel you should build a prototype to demonstrate the idea. Once you have a patent, you can try to sell the idea to a company that produces similar items, or start your own company.

Where do I go to start a patent search and do I need legal help?

Its fairly simple to demonstrate that an invention is useful, but how do you know whether your invention is new and non-obvious? Doing a thorough provisional patent search is how you can find out. Also, if you do your patent research before you find a patent lawyer, youll likely to cut some of your legal costs. If someone else has already come up with your invention, its better to find out early in the process, before you spend money to patent an idea.
