At that time, it was a secondary offense not to buckle the belt, meaning you could not be stopped unless there was another violation, like running a stop sign or speeding. In 2009, it was made a primary offense and you could be stopped for a seat belt violation without committing any other violation. There is currently (February 2015) a proposal to exempt rural letter carriers from having to buckle their seat belts.
