Divorce from gay marriages was 'judicially' legalized Sept. 13, 2004, when a supreme court judge of Canada ruled that the definition of 'spouse' in the Divorce Act was unconstitutional; he approved the first gay divorce application.

When initially passing the gay marriage law in Canada, politicians neglected to account for gay divorce, and did not amend the correct sections in the Divorce Act. This oversight was addressed with the Civil Marriage Act, which was passed in the house on 2005 June 28, by the senate on 2005 July 19, and finally given royal assent on 2005 July 20.

On June 27, 1969 the Criminal Law Amendment Act, 1968-69 (Bill C-150) passed in Canada, making it not a crime for 2 consenting adults of at least 21 years of age to engage in anal intercourse.

The age was later lowered to 18.
