"Yield the Right Of Way" means that the vehicle on the intersecting roadway to your right (at a stop sign) has the legal right of way and they should go before you do. On entering a highway (freeway) by an 'on ramp', the vehicle which is already traveling down the road you are merging onto has the "Right Of Way" and you are required to yield to their vehicle when entering traffic. I would say the vehicle on the right is at fault, because the vehicle on the left is a "passing vehicle." You must always yield the right-of-way and keep to the right of a passing vehicle on the left. Or whoever has the bigger vehicle
The vehicle on the left should yield but, having the right of way doesn't mean the other guy will stop so you still need to be careful.
