To legally obtain the Doctor Who: Christmas Special, I think the only way is to wait for it's release on iTunes and watch it on BBC iPlayer until it's available for download. Hopefully the DVD for the Christmas Special should be available from Amazon, Play and lots of other shops as well soon so if iTunes are a bit slow with putting the special up for download as they seem to be the DVD is always a place you can turn to.
