Anyone who wants to file one can file a civil lawsuit in the United States. Usually a person sees a lawyer and has the lawyer file the lawsuit. If it is not well written, done in the proper manner, and the details are not properly taken care of, it will be useless. In that case, the person is out his filing fee.
