Answer: While the above is true for the Army of Northern Virginia, Lee did not surrender the Confederate States Army or the Confederate States of America. The war continued after the McLean House surrender of 9 April 1865. The 30,000 men of the Department of South Carolina, Georgia and Florida and The Department of North Carolina and Southern Virginis under the command of General Joseph Eggleston Johnston were still fighting William Tecumseh Sherman. This force surrendered at Durham Station, North Carolina on 3 May 1865. On 5 May, the Confederate States were dissolved by the CSA Cabinet and five days later their former President Jefferson Davis was captured.

The Department of Alabama, Mississippi, and Eastern Louisiana under Lieutenant General Richard Taylor made their surrender to Major Gerneral E.R.S. Canby at Citronelle, Alabama on 4 May 1865. The Trans Mississippi Department under Lieutenant General E. Kirby Smith made preperations to fight on as a guerrilla force. Smith went to Houston, Texas to enlist fresh troops, but when he arrived he found out that Lieutenant General Simon B. Buckner had surrendered his force in Smith's name. He joined the few thousand confederate who went into exile in Mexico.

The final surrender was made by Brigadier General Stand Watie of the Confederate Indians in Doaksville, near Fort Townson, Indian Territiry to Lieutenant Colonel Asa C. Matthews on 23 June 1865. The Civil War was over at last.
